Pvt. Charles W. Phillips was a Native American and was buried outside the cemetery fence due to his race. He is now buried at Gaddies' Chapel Cemetery just north of Jackson, Alabama, on Walker Springs Road. He was unmarked and a stone was erected in 2009 by local historians.

5th Sergeant J. I. Kelley, Company D, is buried at New Hope Cemetery No. 2 on the Pleasant Hill Road in Clarke ' County.

James Ephraim Blackwell who served as a sergeant in Company F of the 38th Alabama was born January 16, 1834, in North Carolina and died June 10, 1910, in Jefferson County. He is buried at McDonald Chapel Cemetery in Birmingham, Jefferson County, Alabama.

Alabama burials removed from the battlefield of Chickamauga and vicinity to the State Cemetery at Marietta, Georgia. Those listed below belonged to the 38th Alabama.
